So communicating with the Ford Transit Brand Group and here is what they are telling me at this point.

'We have not finalized the decision on price protection or private offer at this time. We are working on the transfer codes for moving the 2022 orders into a higher priority scheduling and I will get those to you once they are finalized.'

I have the 18 page bulletin that covers the Fleet & Commercial Transits and ALL other vehicles related to Fleet/Commercial designations. So waiting for this same bulletin that covers the Retail Customer orders and will have this once it is sent to me. As stated before the Commercial & Fleet Transit orders do not have any price protection.

I do not understand Ford's decision to balance out all remaining '22 orders without having an answer for this question in place.

I could not be any less impressed with Ford. Or their dealer network. This entire buying process has been the worst customer experience of my life.

Any remaining thoughts that i had that Ford was an honorable company, which were very very very low at this point. and honestly--never been very high, Henry Ford was an @$%&. but i still liked the brand, my favorite car of all time is 63 galaxie 390 vert. BUT, i find it very weird that 22 orders were balanced out or just pushed and pushed and pushed because of lack of "techy" items. funny a few short days after the 22 were balanced out they now have a shipment of sync4 and other items and scheduling and assigning VINS for the more $ 23 models that appear to be loaded. very fishy indeed.

my confidence in getting the 3rd model year in a row order is still at 5%

I have had better customer service experiences with cable providers! I ordered my 22 148HR AWD EcoBoost with RV prep on January 28, 2022. I got an email from Ford that verified my order within hours. I got my second email from Ford on 3/18/22 informing me that they had run into delays and "We know there’s a lot of anticipation when it comes to getting into a new vehicle, so we’ll make sure to keep you updated. Once your vehicle is ready to move into the production schedule, you’ll be hearing from us again."

I never heard from Ford directly and my dealer never contacted me with updates. I did call my dealer every month to check on the status and my communications were friendly but not helpful.

I read about the 22 closeouts on this Forum and contacted my dealer about my concerns and price protection. I was told by both the sales manager and my salesperson that I would have price protection on my order if it was moved to the 2023 model year. I would be contacted about the move and be provided an opportunity to make any available option changes upon resubmission of the order. I was also told that I would keep my place in line and my order priority.

on 7/19/22 I got an email from Ford verifying my order for a 2023 Transit XL with silver wheels. (My original order had black wheels) I called my salesperson and was informed that Ford decided not to honor price protection for transit orders and that Passive Entry/Start, Black Steel Wheels and HID Headlamps were not available options on the new order. To add insult to injury, I was told that I must make a new $1000 nonrefundable deposit on the new order.

I made 1 phone call to the Mercedes Dealer in Mobile, AL and was able to secure a secured allocation (With allocated options) for the September manufacturing run. I notified my Ford Dealer about this opportunity and requested to keep my 2023 order with a nonrefundable deposit. (I will gladly take whichever van arrives first) I was told that this was not an option.

I spent 3 months researching and configuring my perfect Ford Transit. I would prefer to have the option to continue my order. My 2023 order has already been submitted and confirmed with Ford. Is it possible to move this order to another dealer at this point? If not, that person waiving from the Pebble Grey SPRINTER will be JB. 🙋‍♂️

Positive, if frustrating news. Provides some hope for the rest of us. Are you able to share your body style and options list so others can see if there might be any overlap with our orders?
Just called the Marketing number and found out my 2023 order that was submitted on July 5th has a VIN with a build date of 9/12/22. Go figure. I would have preferred to have my 2022 order fulfilled and not pay the extra $6k!!
Ford prefers that you pay the extra $6K

I did not order the PSD on my '22 HR, EXT, AWD because I thought $900. was excessive and I was concerned about things getting trapped in it when closing. I also did not want to pay to have it repaired when its breaks. I'm not the Hulk, and I can assure you after living with my van 3 months it was the right decision for me. The sliding door is well balanced and very easy to close. IF you've had a shoulder replacement I get the need, but otherwise, you may want to drop the PSD. JMHO

I WISH they offered the barn doors on the high-roof model, because I'd have paid any reasonable amount of money for those instead of a sliding door, powered or not. The power slider is my way of assuaging my intense dislike of the zzzzzzzzzzzwhump . . . wait dang it that didn't do it, let me try again zzzZZZWHUMP okay there now it's closed.

Honest to god it was the feature of a new van that I was looking forward to more than almost anything else. Everything else was more of a nice-to-have, but I'd have done without if they weren't available. Like seriously, I'd have dropped the Ecoboost, the Synch4, the adaptive cruise (as long as I still got basic cruise), 360 camera, blind spot, all of that if it meant getting a van. That stuff was more "oh that's cool I might as well".

But dang do I want that power sliding door.

I’m going to be VERY curious if you get your window sticker 10 days before the build date. You are 10 days ahead of me and I’m still skeptical that it will happen.
I'll be F5ing the website like a madman on July 29th.

funny i have started to shop 4x4 econolines again, most 4x4 have barn doors (clears larger tires easier) and i thought to myself--well thats a win. i loved the bard doors on my old econoline 4x4 7.3L diesel

And so in this scenario you're going to show what signed contract and the judgment is going to be what when Ford doesn't show? I'm playing the Devil's Advocate here...

To be perfectly clear on my perspective, in case you haven't followed my post relating to the balance-out issue for 2022,: Ford and their Dealer Network FAILED every last person who was balanced out!

The Dealers failed by not providing a signed contract with terms, the buyers failed by accepting this fact.

Ford failed by not producing vans and then trying to shaft balanced-out buyers with no price protection (to date), and practically no communication during the waiting period.

Is this unfair, immoral, and possibly illegal? Does it suck? YES.

The question remains; WHAT can be done to get REAL results and satisfaction for these folks? So far I haven't seen that plan on this Forum. If you are a brilliant legal mind, sitting on the sidelines, THIS is your cue to step forward with your ideas and position.
I'll answer you. And I got my 2022, so fortunately I'm not in a position to act on it myself, but here's what I would do and say.

If the following are true, then I believe someone who ordered a Transit would have legal recourse against Ford:
  1. They ordered a 2022 Transit while the order bank was open.
  2. Their dealer submitted an order through COVP and the customer received an "order confirmation" email from Ford.
  3. Ford did not build their vehicle except in the situation where they gave the customer the option to change their order so that it could be built (due to parts unavailability) and the customer refused to change their order.
Here is the legal argument:
  1. While the contract relationship is between the customer and dealer, and then the dealer and manufacturer, Ford's pierced the veil when it sent an order confirmation and subsequent communications directly from manufacturer to customer
  2. Ford could have done more to fulfill the contract.
    1. They could have closed the order window sooner under what would be a "downside scenario" for parts availability and if things went better than planned, reopened the order bank for the first X number of orders submitted.
    2. They could have delayed the start of 2023's or co-manufactured 2022's and 2023's until all open 2022 orders are fulfilled and prioritized all 2022's first.
    3. They could have diverted parts resources from other products to the Transit - this is especially true with the SYNC4 parts shortages.
  3. Ford caused you financial harm because they are now requiring you to pay a higher price for what they promised to build at a lower price without an acceptable force majeure situation occurring (because they took the orders when they were already experiencing supply chain disruptions) or made you a promise that caused you to forgo the opportunity to purchase a van on the used market when prices were cheaper.
People can file suit against Ford in small claims court. I have whole previous post on where to file and the limits. Harm could be one of the following:
  1. Price difference from 2022 to 2023 for your build (roughly $6,000), the argument being that Ford terminated your contract without cause and without being able to justify force majeure and is forcing you to pay more to get the same product.
  2. The nominal dollar increase in the average transaction price for a van per CarGurus, the argument being that you could have purchased a used van at a lower price if Ford had not given you a promise they could not fulfill. This is $8,458 from October 1 last year through today.

My old van was a 2008 E-350 with a 20" fiberglass high roof, a former wheelchair van with the 6.8L V-10 and barn doors. His name was Chester (Because when I showed it to my friend, the first words out of her mouth were "Oh god that's the sort of van that Chester the Molester would drive". And the name stuck)

Sadly he was stolen in June 2021, and the police found him a few weeks later completely gutted and stripped. Insurance wrote it off (and actually paid me twice what I'd paid for him).

I still miss him. :(

This dealership deals in a lot of Mavericks. He also mentions in the video that the same process will apply for Broncos. I have to imagine the same process will apply for Transits because why would they differ?

Gist:
2022 order will not automatically transfer to 2023 orders.
They are still waiting to hear from Ford on a way to mark 2023 orders that came from 2022 orders to get priority scheduling. This is different than Transits because Maverick order bank hasn't opened yet so Ford still has time to come up with a plan.
If they don't hear in a week or two weeks, they are going to start entering 2022 replacement orders before new 2023 orders. Because the Maverick 2023 ordering hasn't started yet this will hopefully get the 2022 replacement orders priority over the 2023 orders.

how hard could it possibly be to come up with a plan to prioritize 22 unfulfilled orders, Priority CODE 2R, there ford I solved the great riddle for you. on a side note and I am loathe to speak of this but.....it's been over three weeks since my last reschedule email from ford, have they forgotten about me? or do I just have PTSD from this nonsense, i miss my abuser. August 8th is just over two weeks away. I find myself opening my email several time a day with anticipation of seeing the dreaded "the scheduled for production date has changed" email yet I can't stop expecting it.

Ford is waiting to see how MY23 orders are going. If they can project selling out the 23s why sell them at a price protected discount vs full price for new orders. There is no other reason I can think of to wait.

Your van, give or take the odd option, is virtually identical to my van that has been balanced out 2 years in a row now!
I'm a bit weary and somewhat afraid to line up for strike 3. o_O
There is no rhyme or reason to this fiasco. Not sure if you used the same dealer but it may have something to do with dealer allocation. Maybe it's time to use a different dealer. Even with my one year of getting balanced out, I also ordered a van through CrossleyFord to try and increase my odds. Since I knew that they were a high volume dealer.

So, if we have a my22’ van order with you , do we wait or submit a my 23 and get whatever ford plans for us ( price protection , priority ) added after , or once we submit our my23 order would it be too late to add?
